Final version\u00a0<em>Digital Operational Resilience for the Financial Sector<\/em>\u00a0(or also\u00a0<em>Digital Operational Resilience Act<\/em>In the world of cloud services for financial institutions, the regulation will introduce several interesting innovations. Let's take a look at them.<\/p><p class=\"kt-blocks-info-box-text\">Jan Kubicek<\/p><\/div><\/span><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is \"digital operational resilience\"?<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/CS\/TXT\/HTML\/?uri=CELEX:52020PC0595&amp;from=CS\" target=\"_blank\" rel=\"noopener\">The DORA proposal<\/a>&nbsp;is part of the legislative package&nbsp;<em>Digital finance<\/em>, which aims to promote competitiveness and innovation in digital financial services. Digital operational resilience is defined in the proposal as&nbsp;<strong>the ability of the financial institution<\/strong>&nbsp;<strong>build, ensure and review its operational integrity<\/strong>&nbsp;from a technological point of view.<\/p>\n\n\n\n<p>The regulation therefore focuses on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>risk management<\/strong>&nbsp;in the field of information and communication technologies (ICT)<\/li>\n\n\n\n<li><strong>digital operational immunity testing<\/strong>&nbsp;financial institutions<\/li>\n\n\n\n<li><strong>reporting of serious ICT incidents<\/strong>&nbsp;authorities<\/li>\n\n\n\n<li><strong>information sharing<\/strong>&nbsp;related to cyber threats and vulnerabilities<\/li>\n<\/ul>\n\n\n\n<p>The draft regulation has already been quite favourably&nbsp;<a href=\"https:\/\/ecuc.group\/papers\/ecuc_position_paper_feb_2022_v2.0_final.pdf\" target=\"_blank\" rel=\"noopener\">on the ECUC website<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>ICT risk management for financial institutions under DORA<\/strong><\/h2>\n\n\n\n<p>What is ahead of you as a financial institution? DORA starts by requiring you to have internal management and control frameworks in place for&nbsp;<strong>Effective<\/strong>&nbsp;<strong>and prudent<\/strong>&nbsp;<strong>management of all ICT risks<\/strong>. So, first you need to prepare the following documents:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Strategies<\/li>\n\n\n\n<li>Policies<\/li>\n\n\n\n<li>Procedures<\/li>\n\n\n\n<li>Protocols<\/li>\n\n\n\n<li>Tools<\/li>\n<\/ul>\n\n\n\n<p>If any of the documents are missing, you cannot manage ICT risks well enough to ensure a quick and appropriate response at all times.<\/p>\n\n\n\n<p>First, accept&nbsp;<strong>digital resilience strategy<\/strong>which includes methods for addressing ICT risks and meeting the objectives set. These include, for example, information security, not exceeding the chosen risk tolerance level, establishing mechanisms for detecting and protecting against ICT incidents, etc.<\/p>\n\n\n\n<p>Its digital operating resistance&nbsp;<strong>Test<\/strong>&nbsp;and keep a list of all your ICT incidents&nbsp;<strong>communication strategy<\/strong>.<\/p>\n\n\n\n<p>You also&nbsp;<strong>define<\/strong>&nbsp;His&nbsp;<strong>access to ICT suppliers<\/strong>that you use - and keep track of key dependencies.<\/p>\n\n\n\n<p>DORA also regulates and unifies the system for reporting ICT incidents and determining their impact.<\/p>\n\n\n\n<p>Most importantly, however, DORA introduces&nbsp;<strong>classification of ICT service providers<\/strong>. Why is this significant news?<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646843725190-300x157.jpg\" alt=\"DORA Supervisory Authorities | ORBIT Cloud Encyclopedia\" class=\"wp-image-11565\" style=\"width:444px;height:auto\" srcset=\"http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646843725190-300x157.jpg 300w, http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646843725190-1024x536.jpg 1024w, http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646843725190-768x402.jpg 768w, http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646843725190.jpg 1386w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>Not only banks will be under scrutiny, but also their key suppliers<\/strong><\/h2>\n\n\n\n<p>Companies belonging to the Amazon or Microsoft group are apparently about to get&nbsp;<strong>directly in sight<\/strong>&nbsp;European Supervisory Authorities (such as the EBA).<\/p>\n\n\n\n<p>The draft regulation imposes obligations not only on financial institutions, but also on their major ICT providers - i.e. providers of software, data analytics, data centres and&nbsp;<strong>cloud service providers<\/strong>&nbsp;(but not to ISPs or hardware providers).<\/p>\n\n\n\n<p>The European Supervisory Authorities will determine which ICT service providers are critical for financial institutions. The criterion for the assignment of the lead supervisor will be the total value of the assets of the financial entities. If it exceeds half of the value of the assets of all financial entities that use the services of a given critical service provider, the supervisory authority will be the authority that supervises those financial entities. (The draft Regulation uses the term \"critical third party ICT service provider\" for a critical service provider in most cases.)<\/p>\n<\/div><\/div>\n\n<\/div><\/div>\n\n\n<p><\/p>\n\n\n\n<p>The European institutions will establish\u00a0<strong>Joint Committee<\/strong>which will publish annually\u00a0<strong>current list of critical ICT service providers<\/strong>\u00a0for financial institutions. These are providers that are established in a third country (i.e. outside the EU) if, if they were established in the EU, they would be designated as a critical provider (or - in the words of the draft regulation - would be designated as a \"critical third party provider of ICT services\").<\/p>\n<\/div><\/div>\n\n<\/div><\/div>\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How do you know if a supplier is a critical ICT service provider?<\/strong><\/h2>\n\n\n\n<p>You'll know that the contractor will be on&nbsp;<strong>listed<\/strong>&nbsp;<strong>on the list<\/strong>&nbsp;published by the Joint Committee of the European Institutions. Whether it makes the list depends on several factors:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Systemic impact<\/strong>&nbsp;the stability, continuity and quality of financial services in the event of a sudden problem<\/li>\n\n\n\n<li><strong>Systemic relevance&nbsp;<\/strong>financial institutions that use the supplier's services<\/li>\n\n\n\n<li><strong>Concentration<\/strong>&nbsp;- i.e. the degree of dependence on one and the same provider to provide important functions of the financial institution<\/li>\n\n\n\n<li><strong>Degree of substitutability&nbsp;<\/strong>of a specific provider<\/li>\n<\/ul>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"35\" src=\"http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646844047890-300x35.png\" alt=\"\" class=\"wp-image-11571\" style=\"width:424px;height:auto\" srcset=\"http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646844047890-300x35.png 300w, http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646844047890.png 693w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/figure>\n<\/div>\n\n\n<p><em>Let's look at these factors in a little more detail:<\/em><\/p>\n\n\n\n<p><em>U&nbsp;<\/em><strong><em>systemic impact and systemic relevance<\/em><\/strong><em>&nbsp;the following will be important:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Number of financial institutions, or number of global systemically important institutions or other systemically important institutions relying on the supplier<\/em><\/li>\n\n\n\n<li><em>The interdependence of these systemically important institutions and other financial entities<\/em><\/li>\n<\/ul>\n\n\n\n<p><em>U&nbsp;<\/em><strong><em>Concentration<\/em><\/strong><em>&nbsp;whether the services of one supplier are used to provide essential or critical functions of financial entities will play a role.  It does not matter whether it is a critical supplier involved directly or indirectly as a subcontractor.<\/em><\/p>\n\n\n\n<p><em>Criterion&nbsp;<\/em><strong><em>substitutability<\/em><\/strong><em>&nbsp;critical supplier means that the committee will consider factors such as:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Lack of viable alternatives to a given provider in a particular market<\/em><\/li>\n\n\n\n<li><em>The technical complexity or sophistication of the services provided or the specific characteristics of the critical supplier as an organisation (or its activities)<\/em><\/li>\n\n\n\n<li><em>Difficult migration of data and work tasks when switching to another supplier (due to high financial costs, increased operational risks or e.g. time consumption)&nbsp;<\/em><\/li>\n<\/ul>\n\n\n\n<p><em>Finally, the following also come into consideration&nbsp;<\/em><strong><em>Number of EU countries<\/em><\/strong><em>in which&nbsp;<\/em><strong><em>the supplier provides its ICT services<\/em><\/strong><em>, as well as the number of EU countries in which&nbsp;<\/em><strong><em>there are financial institutions using the supplier's services<\/em><\/strong><em>.&nbsp;<\/em><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"35\" src=\"http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646844091669-300x35.png\" alt=\"\" class=\"wp-image-11597\" style=\"width:434px;height:auto\" srcset=\"http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646844091669-300x35.png 300w, http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646844091669.png 693w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/figure>\n<\/div>\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"150\" src=\"http:\/\/4.184.192.234\/wp-content\/uploads\/2022\/03\/1646844124961-300x150.jpg\" alt=\"What will DORA bring? When? When, if the provider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>fails to provide information and documentation<\/li>\n\n\n\n<li>will not allow investigation and control<\/li>\n\n\n\n<li>fails to submit a remediation report following a recommendation from the supervisory authority<\/li>\n<\/ul>\n\n\n\n<p>The authority will be able to impose fines every day for up to 6 months. The daily rate is&nbsp;<strong>1 % of average daily worldwide turnover<\/strong>&nbsp;of a given critical provider. The penalty can thus rise to up to 6 months after&nbsp;<strong>maximum of approx. 0.5 % worldwide annual turnover&nbsp;<\/strong>of the provider for the previous year.<\/p>\n\n\n\n<p>By comparison, a breach of GDPR obligations can result in a penalty of up to 4 % of the offending organisation's annual worldwide turnover. The maximum penalty under DORA is thus roughly 8 times lower.<\/p>\n\n\n\n<p>The above applies when comparing fines determined as a percentage of turnover. The GDPR allows for an even higher fixed amount to be imposed. It can be difficult to decide,&nbsp;<strong>when exactly to start regulating the new technology<\/strong>. It must not be too soon, lest regulation stifle the new technology. But it must not be too late either, lest the technology has already done a lot of damage in the meantime.
